Are you paying someone?  From your business?  Do you want to know if they are an employee and you give them a W2 or they are a independent contractor and you give them a 1099Misc or the new 1099NEC?

Or are you asking about yourself?  If you are an employee or contractor?  If you are an employee they take taxes out of your pay and will give you a W2 by January 31.
