May I ask for advice on how to file the sale of a second home in Fremont, CA? My sister, brother, and I purchased this house in August 1994 and sold it in December 2024. I moved out and bought a house in San Jose to be closer to work. I retired in 2018 and moved back to provide medical assistance to my mother, who passed away on February 5, 2020, while keeping my other house in San Jose. Even though Mom passed away in 2020, I still come home to Fremont from time to time. My sister lived in the house and was never a rental home. The utility was under my name from the start leading up to the time it was sold. I shared expenses on this house, eg. I paid for the house termite fumigation in September 2020 and all the house renovations in 2024. However, both my taxes and voter registration are registered to my San Jose address. Can I claim tax exclusion - maximum or partial - on the sale of my Fremont home?

The house would have to be your main home for two of the five years leading up to the sale date to qualify for the exclusion of tax on the gain from it's sale. So, it would have to be your main home during two years from 2020 to 2024. That doesn't appear to be the case here.
