You can file a tax return as a resident alien as soon as you are a resident alien.
Hello Robert, as per Substantial Presence Test Substantial Presence Test | Internal Revenue Service (irs.gov), I became a Resident Alien in June 2023. Can I choose to file 2023 taxes as a Resident Alien for the whole year or should I file as dual-status alien?
To clarify, were you a non-resident in the US prior to coming or did you reside in a foreign country prior to arriving in the US?
I did reside in a foreign country prior to arriving in the US
Yes, you are considered a resident alien for a calendar year if you meet the green card test or the substantial presence test for the year. Since you became a resident alien in June 2023, you may file as a resident alien for the entire year.
