Injured spouse and stimulus payment

I just had to contact New York Child support and report child support fraud on my husbands ex. She has been getting child support on their son who she hasn't had custody of in 11 years. My husband is disabled so they can't take from him. She has gotten almost 40,000 in child support from the state of New York. Plus whatever they took from my taxes and from my husbands checks when he did work.

I got both letters from treasury about offset and both letters from IRS stating we’re getting stimulus so now I’m confused.

Everyone is getting the letters stating they will receive their payment. Child support has intercepted it. If you filed a injured spouse form you should get it back.

I got 1 letter from the treasury nothing else since then

Yes but the waiting is the worse.also if they only took 1200 wheres my 1200

To sum it all up ... this stimulus program was pieced together in just 2 weeks during a pandemic & an active tax season  and the IRS is trying their best  to do it right with a reduced staff ... sadly  it will be a bumpy ride for some folks and all you can do is hang on until the ride  is over.  Folks who file injured spouse forms are used to these long waits and this year it is worse due to the virus ... all you can do is wait for the IRS to complete your tax return and process the injured spouse form in due time ... it will all come out in the wash so to speak.

I got a letter today from White house stating I will recieve 1200 but dont know why if mine should say 2400. Is it because attorney general recieved 1200 as well

I got the offset of 1200 to attorney general then today 1 saying from White House about my 1200 so shouldn't mine say 2400

We got 2 letters saying we were not getting it, a letter saying we were getting half of it.

Talked to treasury department and they said both payments were going to  back lay

Were both yours addressed to both of you. Mine doesn't say half or whole it just says 1200. Did my spouse not recieve one an they used my income because mine is the full income on joint return

The same exact thing happen to me and my husband. I go on the "get my payment site" it said your payment scheduled deposit for Apr 15 at that point it was Apr 18- I called my bank nothing there.  I then get 2 letters one with my husband's name and the other with both our names. Stating an amount that I assume was half of the stimulus amount was sent to Child Support via EFT for arrears owed which is fine that is his responsibility. But the other half I am entitled to - and our 3 kids are entitled to. Keep in mind I filed both 2018 and 2019 with a Injured Spouse form. They took half of the stimulus and sent it right away to child support- but here I am and my 3 kids have nothing and didn't receive my part of the stimulus. I cant call, I cant send another form, I know nothing. Im literally at their mercy and to add insult to injury - We filed our 2019 taxes on Jan 30 2020 and have not receive the standard refund.  It was filed exactly as we did on 2018 w/an injured spouse form. It's so upsetting ...

That's where iam so lost at because I call Treasury and they say only 1200 was taken.  So wheres my 1200 I have not filed my 2019 taxes yet but I'm at the point to not put my husband on my stuff so I wont have this issue..But then I'll be paying taxes...I'm **bleep** if I do and **bleep** if I dont...I have his child as well what do they want for me to put him on child support as well and iam his wife. It's sad I need the help as well

I hope this update helps anyone:  I just hung up with the treasury.  I called the number for TOP in the last paragraph of the offset letter and pressed option "4".  I got a real nice person on the other end, and they  of course are getting a tremendous amount of calls about the stimulus payments that were offset due to past child support.  She said that if you have filed the Injured Spouse Form 8379, then you will get your portion that should have gone to you originally within 8-11 weeks.  She said that the "glitch" was caught and they are aware of it and are fixing it.  So if you filed your form, you do not need to file again, just wait the 8-11 weeks and it will be paid the way you indicated on your taxes.  She seemed very confident that it would not take longer than that.  I'm marking my calendar and keeping my fingers crossed!  Hope this helps anyone in any little way!

@21Lilah It’s very frustrating for sure! It’s almost like our kids don’t matter because our husbands have kids from another person. It’s so unfair that we have to even file injured spouse every year it says on the taxes how much they make (mine made nothing) so take their portion not ours and our kids! The stimulus check makes me even more mad because we ALL just dealt with getting our entire tax refund taken so that was no help on bills and then they say ALL Americans will get the stimulus yesss praise God..nope justttt kidding we are going to take that too and make you struggle more!! 😡😡😡 we have rights and needs too! I hope they figure it out soon!

@DP01 Thank you so much for posting your message it does give  me a sense of hope that you actually spoke to a live person and they gave you some sort of real time information. At least we know that the issue has been identified and that they are aware of it and we just wait and see. again thank you for at least posting that it gives me some sense of comfort
