I received a 1099-misc but not self employed

The question is there.  But if you select manufacturer's incentive payment, all those screens are skipped - it automatically goes to other income.   You only get the questions below if you choose None of the above on that screen.  

 

  1. Describe the reason for this 1099-MISC > 
  2. Do any of these uncommon situations apply > None of these apply***
  3. Did the payment involve work like your main job > NO
  4. How often did you get the payment > got it only in 2023
  5. Did it involve an intent to earn money > NO - see below
  6. Do you have another 1099-MISC > NO

@fcp3 The screen with the 'not an attempt to earn money' is included in my TurboTax 2023 software for a Form 1099-MISC

The question "Did it involve an attempt to earn money" does not appear in my TT Premier 2023.  As I have said changing it to "Manufacturer's incentive" eliminates the SE tax, but the bug is concerning

What did you select on the "uncommon situations" screen when you did not get the "intent to earn money" question? And what did you answer to the questions about "work like your main job" and how often you got the income?


On the screen that asks how often you got the income, you have to select only "I got it in 2023," and not any of the other choices on that screen. If you checked any of the other boxes on that screen, that's why you did not get the "intent to earn money" question." That's not a bug.

But But I did get it in 2022 2021 etc. And it is not like my main job because I am retired. It is a bug if the intent to earn money only covers one year and not recurring events, like the solar rebate. The intent to earn money question never appeared, although using the same data since 2018, that question was there. This is a bug. Nothing has changed in my tax situation ( this is the exact same data as 2018) but TT throws this monkey wrench in.

I just did a test in 2022 TurboTax and it worked the same way as 2023. You might have answered the questions differently last year. In any case, call it a bug or call it a design decision, this is the way the software works. It might not be perfect, but you now have two ways to get the result that you want.

The form should ask the income intent upfront and skip the other questions.

Avoid sched C

This applies to Form 1099-NEC, 1099-K, 1099-Misc et al and to other taxable income without a report.

Enter it in the personal section, Other Common Income Form 1099-MISC.  To ensure it does not go to Schedule C (self-employment), you will answer the follow-up questions accordingly. 

 

On the Describe the reason for this 1099-MISC screen, enter a description of the other income. (award/stipend)

Select None of these apply on the Does one of these uncommon situations apply? screen.

Select No, it didn’t involve work like my day job on the Did the involve work that's like your main job? screen.

Select I got it ONLY in 2023 on the How often did you get income for? screen.

Select No, it didn’t involve intent to earn money on the Did the work involve an intent to earn money? screen.

 

Answering differently to any of these questions will imply self-employment and generate Schedule C.
