I have a 1099 Misc from "UAW-FCA-Ford-General Motors Legal Services Plan." It is considered a taxable fringe benefit not self employment. In a loop I can't resolve.

You don't need an accountant to report this correctly.   You need to delete the Schedule C that erroneously started when you entered it the first time.   How to delete Schedule C.   Then delete the 1099-MISC that is causing the issue.   Once the previous forms and schedules are deleted, re-enter the 1099-MISC as follows.  

 

Please make sure to delete the Schedule C and 1099-MISC that are currently entered before you re-enter it using the instructions below.    

 

In the Personal/Wages & Income section, under Other Common Income, select Start or Revisit next to Form 1099-MISC.   Enter your 1099-MISC info on the Let's get the info from your 1099-MISC screen and click Continue.  If you’re editing a 1099-MISC you already entered, select Edit next to your form.

 

  1. On the Describe the reason for this 1099-MISC screen, enter UAW-FCA-FORD-GM or similar.
  2. Select None of these apply on the Does one of these uncommon situations apply? screen.
  3. Select No, it didn’t involve work like my main job on the Did the involve work that's like your main job? screen.
  4. Select I got it only in 2023 on the How often did you get income for? screen.
  5. Select No, it didn’t involve intent to earn money on the Did the work involve an intent to earn money? screen.
  6. Select No on the Do you have another 1099-MISC? screen.

Answering differently to any of these questions will imply self-employment and generate another Schedule C.  @MBel

I HAVE THE SAME PROBLEM.  TURBO TAX PREMIERE VERSION SIMPLY WILL NOT PROCESS THE 1099-MISC FROM "UAW-FCA-FORD-GENERAL MOTORS LEGAL SERVICES PLAN" FOR A FRINGE BENEFIT.  I'VE SPENT HOURS ON THIS.

Go back to the section of the return where you made the entry. Remove it completely by selecting the trash icon next to it when you arrive at the summary page. Now go to;

 

  • Tax tools
  • Tools
  • Delete a form
  • Locate any Schedule C references and SE TAX in the list of forms and delete them, if they are there.

Now go to;

 

  1. Log into your TurboTax account if it is not open.
  2. Click on the Wages & income tab.
  3. On the screen, Your income, scroll down to Less Common Income.
  4. Click the Start or Update button on the line  Miscellaneous Income, 1099-A, 1099-C.
  5. On the screen, Let's Work on Any Miscellaneous Income, scroll down to Other reportable income and click Start or Update 
  6. On the page, Did you receive any other taxable income? Click Yes.
  7. On the next page, Other Taxable Income, enter a description (1099-MISC UAW Fringe Benefit) and the amount. Click Continue.
  8. Scroll through and answer the questions, if it asks if this is like your main job, say no.
  9. if it asks how often you get income from it, say you got in 2023 and any other years you receive this fringe benefit.
  10. Then it asks if you have the intent to earn money. Say no
  11. Finish out the section.

If done in this manner, you will pay tax for the benefit but you will not pay self-employment taxes as this income is not self-employed income.

HOW DO I GET BACK TO THE 1099-MISC SCREEN TO CORRECT THIS INFORMAION ONCE I AM IN THE RECHECK JUST BEFORE E-FIULING?

Go back to the Income section of your federal return in TurboTax and scroll down until you reach "1099-MISC and Other Common Income."  Click "Update" next to 1099-MISC.
