HSA Excess contribution issue

I’m trying to file my 2024 taxes and the smart check is giving a validation error on form 8889 box 1 to indicate CDHP coverage for myself or family, but I don't have a CDHP.

 

In 2023 I made excess contributions to my HSA of $509.  During they year I changed employment & lost my CDHP, and at the end of 2023 my HSA fund was only $2.  My 2023 taxes showed the excess contribution & taxed it as income on form 5329. Note the HSA balance is $0; I lost my $2 due to account fees.

 

I’m trying to file my 2024 taxes and the smart check is giving a validation error on form 8889 box 1 to "indicate CDHP coverage for myself or family".  Again - I don't have CDHP coverage anymore so it should be blank. 

 

Note the excess contribution information was auto populated by TT when I carried over the info from my 2023 taxes. 

Back to the 2024 return - if I look at the form view of Form 8889-T,  "line 2 smart worksheet", "B-Excess HSA contributions carried over from 2023 that still in HSA" has an entry of $509.  That carries down into "Line 2: HSA contribution made in 2024" entry of $509.  Also - "line 18 smart worksheet"  shows the contributions from 2023 & shows the $509 excess contribution also. 

 

Since I already reported the $509 excess contribution as income in 2023, why is TT reporting it as a contribution that is STILL in my HSA in 2024?  It seems like TT is not recognizing that I already paid on the excess contribution in 2023 & that the balance is $0. Please help me understand how to proceed.

I am sorry if I did not make myself clear - please do answer "Family" or "Self" in the Review when you hit that screen. I just wanted you to know that the numbers on your 8889 will be correct no matter which answer you give.

It is correct that if your contributions were through your employer (code W in box 12 on your W-2), then the 2023 excess of $509 would have been added back to income on your 2023 return.

 

Any excess that is carried over to the next year (because it was not withdrawn by the due date of the 2023 return) is carried forward to the next year 2024. This is done so that the excess contribution can be used up in your 2024 return. 

 

Your problem is that you no longer have HDHP coverage (CDHP is an industry term - the IRS refers to a High Deductible Health Plan (HDHP)) so unless you get HDHP coverage at some point in the future, that $509 will just keep rolling over.

 

This rollover can be stopped by taking that amount out of the HSA and telling TurboTax that it was not spent on medical expenses, note that this will be added to your Income along with a 20% penalty. 

 

But since you no longer have any cash in your HSA, you no longer have anything to withdraw.

 

The only good news is that the penalty for the carryover is actually the lesser of the carryover or the value in your HSA at the end of the year. From your description, you no longer have any cash in your HSA. So TurboTax will continue to carry over this  $509, create an 8889, create a 5329, and at the end penalize you nothing.

 

To my knowledge, the IRS has not addressed this issue of endless carryovers that you can't cure and for which you eventually will not pay any penalty. But this covers your 2025 return, at least.

Good information - thank you for the help.  

If I dont have a CDHP, it sound like this $509 carry over every year on my taxes like this - is that correct?

Most importantly - I am still not clear on how to proceed with the tax filing - the Federal "smart check" in Turbo-Tax is giving a validation error on form 8889 box 1 to indicate CDHP coverage during 2024 for myself or family, but I don't have a CDHP; should I leave it blank?

Yes, the $509 will continue to carry over until you get HDHP coverage again - which, of course, may be never.

 

However, as I pointed out, now that your HSA value has dropped to zero, there will be no penalty charged to you.

 

In the Review, TurboTax asks you to choose Self or Family for your HDHP coverage - however, you don't have any HDHP coverage.

 

But since you said that you did not have any HDHP coverage, the calculate of the annual HSA contribution limit will be correct. So don't worry about answering Self or Family, just to get around the gotcha in the Review. The numbers on your 8889 will be correct.

Well - turns out this is still an open issue.  I got the taxes completed & when I try to e-file, Turbo-Tax will not let me because of this open issue/check.  When I proceed to e-file, it takes me BACK to the checking screen "we need to make one more check. Everything looks great....but before you e-file, we need a little more information..." & it takes me back to the screen to select "self" or "family" for the CDHP.  

So now what?  I paid for an e-file feature which seems to have a glitch...
