How do I file the taxes if I'm an IHSS provider?

Yes on this IHSS  W-2 form there was no federal or state taken out so it is being taxed once I enter it in as a traditional W-2 form my question is how do I deduct expenses for my vehicle etc.?Would I do this on a profit loss schedule C or employee expenses?  I’m a little confused because I don’t want to input this income on W-2 line one and again and Sch C

Yes there is amounts in 1 to 16 except for federal income tax withheld box  1. and state income tax withheld box 17.

@Delicateflower67 You can't report income on a W-2 as 'Self Employment Income' on Schedule C.

 

Also, since the tax changes in 2017, you can't deduct 'Employee Expenses' against W-2 income.  If you enter your W-2 in the Wages section, you are correct that you will be taxed on the income.  

 

You can report it under 'Other Reportable Income'  and add the income, and then subtract the income with a second entry, so you have no taxable income, but have reported the income if you want to claim other tax benefits.

How do I file the taxes if I'm an IHSS provider?

For Federal return, I entered W-2 as normal, then I followed the instruction provided here to minus out the box 1 on W2 under "Miscellaneous Income".  This will zero out the Federal side. 

For CA return, no adjustment is needed even though it asks for an adjust for IHSS, right?  If adjustment is made under CA return again, it will back out twice.  I noticed it increased my refund amount.

@Tsalazar  It depends.  Because of the recent court case, if claiming the Waiver Payment can increase your Child Tax Credit and your Earned Income Credit, you have the option to report the income as taxable wages.  In this case, report the W2 as a normal W2 for the Federal Return, but check your state instructions on how to exempt the income on the state return if applicable.

 

However, if you do not get a benefit by including it as taxable income, then you need to report the W2 and subtract out the income.  Please see the description by TurboTax Alumni BarbaraW in the following link:  I don't know where to enter the IHSS tax exempt for IRS

Hi, yess I have a question that I need help with. So I am a parent provider for IHSS. I live with my son and I am his provider so my income is exempt from reporting taxes.
We  live with my sons father and he is the head of household we are not married but can he claim me as a dependent?

How do I file the taxes if I'm an IHSS provider?

In order to be claimed by your son's father he will have to verify you meet these requirements:

 

1. Not a Qualifying Child: The individual cannot be your Qualifying Child and cannot be someone else's Qualifying Child. 

 

2. Relationship: The person must either have lived with you for the entire year as a member of the household (a person who is not actually related to you may meet the requirements in this way), OR be related to you in one of the following ways:

·         Your child, stepchild, grandchild or other descendant of one of your children (or stepchildren or foster children). A child whom you legally adopted is always considered to be your child.

·         Your son-in-law, daughter-in-law, brother-in-law, sister-in-law

·         Your brother, sister, half-brother, half-sister, stepbrother, stepsister

·         Your parent, stepfather, stepmother, father-in-law, mother-in-law, grandparent, and, if related by blood, aunt, uncle, niece, or nephew (Also note that, for the purposes of this requirement, divorce or death does not change any relationship which was established by marriage (e.g. son-in-law, daughter-in-law, etc.) 

 

3. Gross Income: The person must have made less than $4,300 in gross income during 2021. 

    (You have the option to exclude your IHSS income)

 

4. Support: You must have provided more than half of the individual's total support during the year.

 

You will also need to answer the following questions to determine if you can claim them.

  • Are they a citizen or resident? The person must be a U.S. citizen, a U.S. national, U.S. resident, or a resident of Canada or Mexico. Many people wonder if they can claim a foreign-exchange student who temporarily lives with them. The answer is maybe, but only if they meet this requirement.
  • Are you the only person claiming them as a dependent? You can’t claim someone who takes a personal exemption for himself or claims another dependent on his own tax form.
  • Are they filing a joint return? You cannot claim someone who is married and files a joint tax return. Say you support your married teenaged son: If he files a joint return with his spouse, you can’t claim him as a dependent.

In 2022. I made around 12k as IHSS privider. Each paycheck there was no tax withholding, just SS taken out.

Could you please let me knpw how much taxes with I have to pay. Thanks in advance.

As an In Home Service Provider you would file as a self-employed individual.  If you are single and made less than $12,950, you will not owe any income tax.  However, you do have to file a tax return because you will probably owe "self-employment taxes".

 

The self-employment tax rate is 15.3%. That rate is the sum of 12.4% for Social Security and 2.9% for Medicare.
