Hello, I had a quick question. I am currently doing my taxes and my boyfriend asked me to ask about claiming his 8 year old son. Can I do that?

I have financially supported both this past year, but wanted to make sure before I did it. If it's a yes is there a form I have to have him fill out?

Hello, I had a quick question. I am currently doing my taxes and my boyfriend asked me to ask about claiming his 8 year old son. Can I do that?

Your BF wants you to claim his son?   Is your BF not filing a tax return himself?  Did your Behave no income at all?    If your BF's son lived with you for the WHOLE year in 2023 and you paid for over half the child's support, you might be able to claim the child and get the $500 credit for other dependents.  Your BF's child is not a qualifying dependent to allow you to file as Head of Household; you cannot get earned income credit, the child tax credit or childcare credit by claiming the child.   No, there is not an extra form to fill out. 

 

If your BF lived with you all of 2023 and had less than $4700 of income, you may also be able to claim him as a dependent and get the $500 credit for claiming him.

If your boyfriend's child is not your biological child, then you can only claim the child as a dependent if:

1. the child lived in your home all 365 days of the year

2. you paid more than half the child's financial support

3. no other taxpayer can claim the child as a dependent.

 

Your boyfriend is a taxpayer if he has more than $13,850 of taxable income, or if he has more than $400 of self-employment income, or if he has less income but files a tax return for any reason except that he owes no taxes and wants a refund of his withholding.  If he is a taxpayer, and the child lives with him, he can claim the child, and you can't, even if your boyfriend wants to allow it.
