File taxes as Head of Household when my wife has no income

I wonder if I can file taxes as Head of Household even when I am married but my wife is under a visa that makes her not elegible for a work permit so she has no income, she is in fact my dependant the same as my 2 children (ages 10 and 7) they all has ITIN number.

No, you cannot file as head of household.  You are married.  Your choices are Married Filing Joint and Married Filing Separate.

@bentur77  if your spouse / wife is living in your tax home, it is more advantageous to file a Married  Filing Joint.  You can file  Head of Household  if you have  lived  away from spouse for the last six months of the year.  Thew filing status has nothing to do with whether the spouse has income or not.

So if she has no income how should I include her when filing joint? can I include her as a dependant?

@bentur77   No ---  In your personal information area , you enter your details , then hers and  your dependent children.  TurboTax will then  select your filing status as MFJ  ( Married Filing Joint ).  Everything else is normal.

 

A point I did not touch on -- if you are on a visa  -- which visa ?  and when did you enter the country ?  I am trying to be sure that you are a US person and that you need to file form 1040 and not 1040-NR for the tax year 2024.

@bentur77 No.  You select your filing status as Married and indicate that you will be filing the return together with your spouse.

As stated - A spouse is never a dependent.
