Per tax law, if payments have to continue to be made to the estate after the ex-spouse dies, the payments are NOT considered alimony.

“Payments are only considered alimony if….There's no liability to make alimony payments after the recipient spouse dies”

So if the divorce decree stipulates that payments must be made to the deceased ex-spouse’s estate, payments are NOT alimony. 
So do I submit a 1099 to my ex for the payments they receive each year?
