Non_Resident Alien Filing

Hi,

 

1. I am an F1 holder currently studying for my PhD as a Graduate Research Assistant on 50% FTE. I entered the US in January 2021 and have been in Colorado ever since.  My school records say that I am a non-resident alien for tax purposes and they have recommended that foreign nationals use Sprintax.

 

Can I use Turbotax for my filing, given my status? Would this be illegal?

 

2. On the page that says;

 

Which Colorado return

Select the Colorado return you want to file;

Form 104: Colorado full-year resident tax return

Form 104: Colorado part-year tax return

Form 104: Colorado Non resident tax return

 

Which option am I meant to pick?

 

3. Considering your answers to 1 and 2 above would I be eligible for the stimulus check?

    F-1 visa holders are not considered residents until their 6th calendar year in the United States.  At that point, the Substantial Presence Test would need to be met to be considered a resident.

     

    TurboTax does not support Form 1040NR for a nonresident.  You can prepare your return through a company we partner with called Sprintax

     

     

    No, you won't be eligible for the stimulus check as nonresident alien.
