No, you cannot claim him.  In order to claim a dependent who is not related to you, they have to live with you all of 2016.  If he is incarcerated, he did not.

No, you cannot claim him.  In order to claim a dependent who is not related to you, they have to live with you all of 2016.  If he is incarcerated, he did not.

Also yiu must pay more than half of his support.  If in jail the state is paying for his support.
