Injured/Innocent Spouse Relief

I have a question. I got married this year-11/11/2016. I will be filing with my husband, married filing jointly. My husband is currently enrolled in a payment plan with the IRS due to reporting incorrect earnings for tax year 2015. When we file, what form should I file? I am in no way affiliated with his tax return for 2015. He filed Single for that year and I filed as Head of Household and claimed our daughter. Please advise.

You can include the Form 8379 Injured Spouse Allocation with your joint tax return when you file the 2016 tax return.  TurboTax includes this form in the program.  See this TurboTax support FAQ - https://ttlc.intuit.com/questions/1910698-how-do-i-file-form-8379-injured-spouse-allocation
