There are details missing from this story. If you were out of work and had NO income then you did not have to file a tax return. If, however, you were unemployed and received unemployment compensation from your state, that unemployment is taxable income. What tax year are you asking about? What "other" income -- if any-- did you receive for that year?

One of the requirements for submitting a claim is that you received an IRS notice saying that you owe penalties or interest. Just being told over the phone that you owe is not enough to establish a claim. You have to send TurboTax a copy of the notice from the IRS as part of the claim.
