For me the grey area is that in Germany my wife lists the children on her German income tax reporting. She does not claim them for US tax purposes as she does not file in the US. So is she claiming them from a US tax perspective or not because I would like to.

The fact that your wife is not filing a U.S. tax return leaves you free to claim them - as long as they meet the criteria listed in the previous replies.
