I am filing head of household because me and my husband don’t live together because I Receive low income Housing and he is not on my lease is the correct?

To file as head of household when you are married, you must have lived apart from your spouse for all of the second half of 2018, AND provide care in your home for a qualifying dependent, AND pay more than half the cost of maintaining that home.

In your question, you didn’t mention a qualifying dependent.

For living together or apart, what counts is where you and your spouse actually lived. If you lived in the same apartment but he was not on the lease, you did not live apart. If you are playing games with section 8, don’t also play games with the IRS.

For the question of whether you paid more than half the cost of maintaining your home, you have to consider all the other sources of support you had. If you are paying less than fair market value for your apartment because of government assistance, that counts as support provided by the government. If your spouse gives you assistance, or if you receive food stamps or welfare, or other government benefits, or assistance from other family members, that all counts as support not provided by you.    You must pay more for your housing than all the other sources of support added together.

You receive low income housing.  That likely means the government is paying part of your rent, even if it is not out in the open.  If a similar apartment would rent on the fair open market for $800 and you pay $400, that counts as the government providing $400 per month of your household support.

People who receive housing suppprt often receive other forms of suppprt.  You may not, but it is important to give a complete answer to the question.  And it is not unheard of for people who live together to claim they live separately to qualify for increased benefits.  If you don’t do that, that’s good for you.

And I don’t see why you think it is insulting to suggest your spouse might be helping you with living expenses.

The answer is what I said in the first paragraph.  To file as head of household you must live separately from your spouse, and provide care in your home for a qualifying dependent, and pay more than half the cost of maintaining that home (rent, utilities, insurance, and so on). When assessing whether you pay “more than half” the total cost of maintaining your home, you need to consider all forms of support that help you out, which might be nothing, a little, or a lot, depending on your situation.

I can’t see your tax return so I don’t know your income and I certainly don’t know your housing expenses.

I am filing head of household because me and my husband don’t live together because I Receive low income Housing and he is not on my lease is the correct?

Well, if you file head of household, he must file married filing separately, which has several disadvantages.

As long as you are married, you are allowed to file a joint return, even if you have separate homes.  Just because you also qualify for HOH doesn’t mean you must file that way.

I am filing head of household because me and my husband don’t live together because I Receive low income Housing and he is not on my lease is the correct?

I appreciate all the info the main reason I don’t want to file jointly is because he may have tax dates and I don’t want to be liable but I will do my research I’m in no big rush to file anyways

If he has tax debts from before the marriage, the other option is to file jointly and include the injured spouse form.  This is a request to the IRS to consider you share of any refund as separate from his share, and to pay your share to you rather than take it for the debts.  This form will delay your refund somewhat compared to filing without it, but may result in a larger refund.  The form is found under "other tax situations."
