I am a single disabled. Mom and My daughter is 18 still in school. Can I claim her?

Possibly, but if you have no EARNED income, taxable income or a tax liability, it does not give you any type of benefit to claiming her.  Claiming your 18 year old daughter could entitle you to claim the $500 Non-Refundable Other Dependent Credit as well as file as Head of Household. Filing as head of household gives you a higher standard deduction and lower taxable income.

 

If you do have earned income, taxable income or a tax liability, then you can claim your daughter if the following criteria are met:

  • Your child (including adopted and foster children), your sibling, or a descendent of any of them.
  • Age 18 or younger at the end of the tax year OR under 24 (and younger than you and your spouse) if they are a full-time student
  • Lived with you for more than 6 months during the tax year
  • They did not provide more than half of their own support
  • They did not file a joint return, unless it was to claim a refund

If you have earned income, you may also be able to claim the Earned Income Tax Credit
