Estate tax form 1041

My mothers estate has no income and no capital gains, do I still have to fill out the form 1041?  The only asset was a house, which sold well under FMV due to how dated it was inside.  The sale took place just under 6 months after her death. The proceeds will be split up amongst her children.

I have already filled out her personal tax forms 1040 which had little income and well below the personal exemption.  She has not paid any taxes in years.  I plan on sending in these tax forms by mail.

 

Do I need to send in a form 1041 with all the attachments to show that there is no income and no capital gains?

Estate tax form 1041

Yes, you do because although there was no gain the IRS has no idea re the estate's basis unless you report it on the 1041.

 

Also, there's a possibility that the estate could recognize a loss which could be passed through to the beneficiaries (as long as the house was not used for personal purposes).
