Can I claim my 29 year old nephew that I support?

he's currently incarcerated and my wife and I send him money for food and personal hygiene, etc. he's HIV positive and we like for him to eat well. however, when he's released he lives in our household and we provide for him.

Since he is incarcerated then the state/county is providing over one-half of his support. You cannot claim him as a dependent.
