NO.  You can file to be legally separated or divorced, sounds like you're still married.

I have filed for divorce, but my "husband" is on disability and wont be filing, I am afraid that i will have to pay out.

AM I legally Separated if I have filed for divorce?

Filing for divorce does not make you legally separate or single again, you are still married and can choose to file Married Jointly with your husband, or Married Separately without him.
