Repaid moving bonus

In 2019 I was given a $40k moving bonus which I had to repay. I repaid $13k in 2020 and then $27k in 2021. I did not receive any W-2c from my company and when I asked for them this year, they gave me two, one that reflects the $13k repayment and the other that reflects $27k repayment. Both W-2cs only have boxes 5 and 6 corrected and not box 1. I tried amending my 2019 tax return but it does not make any sense since box 1 is not changed. What do I do in this situation? How do I claim the taxes that I paid on this $40k back.

Also, is employer supposed to repay me excess SS taxes withheld? This question came up when I manually changed box 1 to adjust for the $40k repayment and Turbo Tax said that I overpaid SS taxes.

Thank you!

You cannot change the W-2 form to reflect the repayment.  Instead you must report the repayments in the tax years they are repaid ...

In brief, you have a "claim of right."  You would take either a deduction or a credit on your 2020 return for the amount you repaid in 2020, and a deduction or credit for the amount you repaid in 2021 on your 2021 return.  If you have already filed both tax returns, you must file amended tax returns to claim the credit or deduction.  You will make the claim of right on both your federal and state tax returns to get the federal and state tax back.

Your W-2 does not change because it reflects what you were actually paid in 2019.  You can't file an amended 2019 return because your 2019 return was correct for what actually happened in 2019.

You say you got a corrected W-2 with box 5 and 6 only changed.  I assume that your total wages for the year, even after the repayment, were more than the social security maximum wage base.  Did the employer actually refund you the difference in the box 6 medicare withholding?

Search for claim of right, if you need more information, post back here.  You can take the deduction in Turbotax online but for the credit, you need to be using Turbotax installed on your own computer, and you need to manually determine the amount of the credit.  There are several long answers on this forum about how to do it, or ask here if you can't find them.

Thank you very much for your reply! Can you please point me in the right direction on manually determining the amount of the credit.

@Opus 17 when you amend in Turbo Tax, do you enter these repayments under Other Deductions and Credits? As a description do you put it as Claim of Right? Thank you!

There are two methods.

1. Special itemized deduction.  This is a deduction that is still allowed even after tax reform and is not subject to the 2% rule, but you must already itemize to get the full benefit.  It's under other uncommon deductions, there is a question about repayment of wages.

2. Tax credit.  This is a direct credit.  The amount of the credit is amount that your 2019 tax would have been reduced if you had not received this income.  Since you have two credits, you have to refigure your 2019 tax return twice.  If you have Turbotax 2019 installed, you can do this (use a copy of your tax return).  First, subtract the 2020 repayment, then subtract the 2021 repayment, and see what your tax liability would have been.

For example, suppose your 2019 salary was $150,000 and your tax liability was $35,000.  (Your liability is form 1040 line 24, it's the net you paid to the government regardless of withholding and refunds.). Refigure your 2019 taxes by changing your W-2 line 1 to remove the @$13K 2020 repayment.   Suppose that reduces your tax to $32,000.  That means your credit for 2020 is $3000.  Then take out the $27K from 2021.  Suppose that reduces your tax a further $8000.  That's the credit on your 2021 return.

Once you figure the credit, you enter it as a special adjustment on line 12d of Schedule 3.   You will have to do this manually in Forms mode.

If your income, tax bracket and itemized deductions are about the same year over year, the deduction and credit will save you about the same amount of money.  If things have changed, you may want to test both procedures.  You are allowed to choose the method that saves the most tax.

I don't know anything about claim of right repayments in state taxes.  You will have to check over your state tax forms and instructions, or see if Turbotax customer support will help you.  (They don't provide tax advice but should help with how to use the program.)

One final note, you can only use the tax credit method if you believed at the time you received the money that you had an unrestricted right to it.  That means, for example, if you knew ahead of time that you would probably move and change jobs, then you knew you didn't have an unrestricted right to this money, so you can't use the credit method, only the deduction method.

@Opus 17 thank you very much for your answer. And in this situation, do I need to amend 2019-2021 tax returns or just 2020 and 2021 when the repayments were made?

Nothing about 2019 changes and you don't amend.  Your 2019 return reports and pays tax on what you were actually paid in 2019.  The fact that you had a wage repayment is dealt with in the year the repayment occurred only, because it doesn't change what actually happened in 2019.

@Opus 17 what is the difference between entering that credit as a special adjustment on line 12d of Schedule 3 rather than on Line D Claim of Right, IRC 1341 credit for repayments of prior year income under Other Credits and Payments Smart Worksheet of form 1040/1040RSR Wks?

For 2022, claim of right repayments go on line 13d of schedule 3, they have revised the form.

When using the smart worksheet, it should place the credit on line 13d for you, that way you edit the worksheet rather than directly editing the form.  However I have not installed the 2022 program yet so I can't be sure.
