You ask for legal requirements under OR law. That is divorce law not tax law.   Ask your lawyer.

As ee-ea stated how you agree to divide is between you and the lawyers/courts.  As for the tax requirement, the total interest entered for the mortgage interest deduction cannot exceed the total interest paid for the year (typically box 1 on a form 1098).
