I file the proper injured spouse forms to save my spouses child support debt for previous children ( not mine) from taking my entire return for my husbands back owed child support. I am the only one employed. He is not employed. They still take a portion for his child support debt but I get a good portion back. It does delay processing tremendously. Its worth waiting to get my portion of the return. In one check, direct deposit. The stimulus payment got split into two checks. Directly in half, one had only his name, the other had both our names?? And somehow child support in Hawaii was able to intercept both payments. The entire stimulus payment for his back owed child support? Please advise.

it is not clear at the present time if inncent spouse filing protects stimulus. the IRS will be sending out letters and needs to clear up a lot of issues concerning it.
I got both letters. There is a section explaining that you need to file the injured spouse form if you feel you are not responsible for the debt. Weird thing is, I did. The last 3 years. I thought it was weird that they split the stimulus in half we file jointly and have 2 children. One had only his name, one had both our names?? They took both payments, entirely. To top it off on the IRS tool it says it was deposited into my bank account. Good grief. Found out why its not in my account when I received the two letters in the mail today. Hawaii Child Support. One addressed to just him. One to both of us. These were the letters I received from the department of treasury.
Same here. Spouse owes, my and our son's stimulus payment taken along with his. I file injured spouse every year, and it was still taken.
I didn't receive my half of the stimulus check due to my husband and I filed jointly together in 2018
I mailed in the form 8379 injuried spouse to the IRS
I haven't heard or received what happens next
Will I receive my half and my children's half
