Are they disabled, and you must pay someone to stay with them while you work?

They are not disabled.  I believe I read in the TurboTax documentation that they were disabled OR at least 62 years old.  Is that not correct?

You must have paid someone else to care for them.

 

The Qualifying Family Member:

  • must be at least 62 or determined disabled by the Social Security Administration
  • is the taxpayer or an individual related to the taxpayer by blood, marriage or adoption

Qualified services include:

  • Home Health Agency Services
  • Personal Care Services
  • Personal Care Attendant Services
  • Homemaker services
  • Adult Day Care
  • Respite Care
  • Health Care Equipment and other supplies which have been determined by a physician to be medically necessary.

Services must be from an organization or individual that is not related to the taxpayer or the family member.

If my parents live with me and I pay all their home, utility, and (some) food expense, can I claim that on the Georgia state dependent care credit?

They may be your tax dependents, if you provide more than half their support AND their taxable income is less than $4300.  

 

Then the "dependent care" credit is for when you pay for care services for someone who is your dependent, and who is unable to care for themself, so that you can go to work (and your spouse if you file jointly).  

 

So the dependent care credit is something additional from just claiming them as dependents.
