How to unclaim the Earned Income Credit

TurboTax provides me with Earned Income Credit which I do not want to claim. 

 

In TurboTax, there is no option to unclaim this credit in an appropriate way. I read other discussion posts, but none of them works

 

Here is what I tried: 

(1) For the TurboTax online, I deleted 8862 form in the Tax Tools -> Tools -> Delete a form. I cleared the cache and refreshed the page, however, it does not work

 

(2) I also deleted "Earned Income Worksheet" and "Earned Income Credit Worksheet" in the section of "Delete a form" page.  However,  even if I clicked on "delete" button to remove them, these two forms are still there. I tried it many many times.  very very tired ....

 

(3) From other discussion posts, I did not find any other related form that I should delete 

 

(4) One post said we could answer an interview question by choosing " I got an IRS notice saying that I can’t claim the Earned Income Credit in 2021".  However, is it ok if I did not get the letter actually? Will it trigger some negative consequences? 

 

 

So, are there anything I should do to unclaim this credit?  Appreciate it if someone could help 

 

I really hope TurboTax could add an option for our users to directly unclaim the credit in the interview questions of the EIC part.

There is no way to unclaim it, as the IRS will just put it back.  If you object to the EIC, why not donate that amount to charity?

Why do you not want to not claim it?  You are not allowed to not claim it so that somebody else can claim your EIC.  

If you are not entitled to EIC, but TT is giving it to you anyway, you've entered something wrong.  Explain your circumstances and somebody may be able to help you.

As non-citizen and non green-card holder,  we are not sure whether claiming it would have some negative effects in the future. So it would be safer to unclaim it at the current stage.

Really, IRS will put it back automatically?   I thought, for benefits, people could choose to claim or unclaim it.  I know people could do it (unclaim it) for the tax treaty.

According to the IRS:

To claim the EITC, you and your spouse (if filing jointly) must be U.S. citizens or resident aliens.

If you or your spouse were a nonresident alien for any part of the tax year, you can only claim the EITC if your filing status is married filing jointly and you or your spouse is a:

U.S. Citizen with a valid Social Security number or
Resident alien who was in the U.S. at least 6 months of the year you’re filing for and has a valid Social Security number

Thanks.  We are the resident alien for tax purposes, and eligible for EIC.  Due to some concerns, it would be safer to unclaim it currently.  That is why this question is raised

Yes, I understand that and it is true that the IRS has been adding credits to returns this year. 

 

I do not know what your concerns are, but the IRS may be concerned as to why you did not claim the credit when you are eligible. 

 

Basically, if you are eligible, claim it. If you are not eligible, it shouldn't be available. 

 

The only way to not claim it is to do you taxes by hand, overlook the credit and mail the return in. 

Again, after a review the IRS might apply the credit regardless.
