My husband is a road driver that goes out ie. Monday night at 10:00 and comes home Wednesday morning around 10:00 am. Would this qualify as a 24 hours period at $63 AND a partial time period at the $47.25?

Generally, the per diem rate can be taken only when the driver spends the night away from home. So if your spouse is away for two nights, you could claim two days per diem. A more conservative approach would be to take one and one-half days of the standard rate. The per diem rate for meals effective October 1, 2017 is $63 per day.
