I live and work in Canada. I would like to use the Foreign tax credit not the FEIE. How can I do this if I don't have a W-2 or 1099? My employer/bank does not have EIN.

I get T4, T4E and T5 forms from my employer, unemployment(government) and bank accounts. I cannot enter these forms as they don't match the W-2 and 1099. How should I do this in order to use the foreign tax credit? Canada has a higher income tax rate than the US and it recommended for people to use the foreign tax credit in this situation. Thank you.

To enter Foreign Earned Income -

  • Click on Federal Taxes (Personal using Home and Business)
  • Click on Wages and Income (Personal Income using Home and Business)
  • Click on I'll choose what I work on (if shown)
  • Scroll down to Less Common Income
  • On Foreign Earned Income and Exclusion, click on the start or update button

Or enter foreign income in the Search/Find box located in the upper right of the program screen.  Click on Jump to foreign income

I understand how to enter the Foreign earned income exclusion (form 2555). My question is how do I enter my information for the foreign tax credit form (form 1116) with out a W-2? The platform will not let me proceed to the next step if I can’t enter a EIN, which I don’t have because my employer is a foreign entity.

You can have a foreign credit  form 1116   OR   the foreign income exclusion form 2555 but not both. 

 

 

If you want to switch from the deduction to the credit:

  1. Open (continue) your return and search for foreign tax credit.
  2. Click the "Jump to" link in the search results, then keep going until you get to Do you want the deduction or the credit?
  3. Click Take a Credit and proceed.

Most people are better off taking the credit, as it's a dollar-for-dollar reduction in your taxes.
