I don’t know if I’ve ever received the American opportunity tax credit

Back I’m 2007 to 2010 I went to school, I don’t think I ever once received the American opportunity tax credit. I did get married once and for one year my ex wife might have received it. I tried to find my old tax returns but the irs website won’t go back far enough to see if I claimed it in 2009 or 2010. I don’t think I did but I’m pretty sure I used the hope credit. TurboTax is saying I qualify. Does TurboTax actually check, or is it going off of what I input? I’m sure I could at minimum qualify for a year or two, but what happens if I’m wrong? Last time I had a mistake on my taxes I didn’t find out for years and I don’t want to receive a massive bill years from now.

TurboTax has no ability to check for past use of the credit because any action with the IRS is protected and private.  If you are wrong eventually the IRS will reconcile the tax return with prior years but it will take them a while, up to two years, which could potentially cost you penalties and interest.

 

The hope credit carries the same standing as the American Opportunity Credit (AOC) meaning if it was used then it's part of the four year maximum.  If you believe you are entitled to at least one more year you can file that way or obtain the earlier transcripts and then amend your return if you run out of time waiting on the requested transcripts from prior years.

 

Prior year tax returns can be obtained in the following ways, which include options other than online.  If you want an actual copy of the tax returns, notice the fee below.

 

There are three ways for taxpayers to order a transcript:

  • Online Using Get Transcript. They can use Get Transcript Online on IRS.gov to view, print or download a copy of all transcript types. Taxpayers who are unable to register or prefer not to use Get Transcript Online may use Get Transcript by Mail to order a tax return or account transcript type. Please allow five to 10 calendar days for delivery.
  • By phone. The number is 800-908-9946.
  • By mail. Taxpayers can complete and send either Form 4506-T or Form 4506T-EZ to the IRS to get one by mail. They use Form 4506-T to request other tax records: tax account transcript, record of account, wage and income and verification of non-filing. 

Those who need an actual copy of a tax return can get one for the current tax year and as far back as six years. The fee per copy is $50. Taxpayers can complete and mail Form 4506 to request a copy of a tax return and mail the request to the appropriate IRS office listed on the form.

Does any of these methods work for going back to 2009? I tried online but can’t go back far enough. I left school in 2010. Also, when me and my ex wife filed together, if she did get it, does that count toward it?

You can only file a tax return for tax refund within 3 years of the due date of the original tax return.

For a 2009 tax return the amended return had to be filed on or before April 15, 2013.  So no tax refund would be paid for the 2009 amended tax return.

I’m sorry I need to be more specific, I mean can I get a copy of my taxes to see if I claimed the credit back in 2009? I’m not trying to modify or file anything from 2009, I just want to see if I’ve ever claimed the credit. The online options don’t go back far enough.

Please also note that if you have completed four or more years of higher education, you are not eligible for the American Opportunity tax credit, regardless of the number of times you have claimed it.

 

To be eligible for AOTC, the student must:

  • Be pursuing a degree or other recognized education credential
  • Be enrolled at least half time for at least one academic period* beginning in the tax year
  • Not have finished the first four years of higher education at the beginning of the tax year
  • Not have claimed the AOTC or the former Hope credit for more than four tax years
  • Not have a felony drug conviction at the end of the tax year

I appreciate that, I have not. But yeah, I need to find out how to check my taxes back in 2009 and 2010. Most methods don’t go back that far.

The IRS and TurboTax only retain federal tax returns for the past 7 years.  So there is no way to retrieve a federal tax return from 2009.

So is there any way for me to verify I haven’t claimed it before? Or am I going to have to just guess? That kind of sucks
