How do I prevent getting an amount in the EIC?

When you go through the EIC section in TurboTax, you will be asked the following questions.   If you don't qualify for the reasons below, you will be able to indicate that when you go through the EIC interview.    Search for EIC and use the Jump to EIC link to get to the interview.  

 

  • Have earned income; and
  • Have been a U.S. citizen or resident alien for the entire tax year; and
  • Have a valid Social Security number (not an ITIN) for yourself, your spouse (if filing jointly), and any qualifying children on your return; and
  • Not have investment income exceeding $10,000; and
  • Not be filing a Form 2555 or 2555-EZ; and
  • File a return with the Single, Married Filing Jointly, Head of Household, or Qualifying Widower filing status, even if you're not required to file a return.

 

If the IRS told you that you cannot claim the EIC in 2021, mark that box on the Uncommon Situations screen.

You do not need a dependent in order to claim EIC, if your income is low enough.

And....the criteria for EIC changed for 2021 tax returns, so you might be surprised to be eligible for EIC this time.
