No, you can only have one domicile and it will remain the state from which you have “moved” until you have taken the proper steps to change it to your new state of domicile. You will file your taxes as a resident in Louisiana.

Driver's licenses, where you are registered to vote and where you register your vehicle, are some factors into figuring out your domicile.

Since you have not yet had a physical presence in the State of California or made any of the above changes, you are not considered a resident for income tax purposes.

At what point did you become a California resident? If you have actually established residency in November, then you owe the CA tax.

Am I a resident?

You’re a resident if either apply:

  • Present in California for other than a temporary or transitory purpose
  • Domiciled in California, but outside California for a temporary or transitory purpose

There are more factors for determining residency. Visit Guidelines for Determining Resident Status (FTB Publication 1031) for more details.

We are living in our motor home traveling while waiting for our new house to be finished being built. Have not closed on the new house yet. Just using our daughters Ca address for mail since November 5 when our la house sold. We are retired.

Our driver’s license and vehicles are still registered in La.
