My mom was on Social Security retirement and disability. She has since passed away. I believe she got her first economic relief payment, but am not sure if she got her 2nd or 3rd. I still have her 1099s for SS and filing would be fairly simple. Can I just file the 1040 for the tax credit with the IRS denying it if she had, in fact, already received it? I'm not trying to commit tax fraud, so I don't want them to accidentally distribute it a second time. Would they just let me know she'd already received the credit upon filing it?

It is too late to seek the 1st or 2nd EIP payments even as a recovery rebate credit. The deadline for that was May 17, 2024.
If she filed a return for 2021, there was a recovery rebate credit for the 3rd EIP payment which would show up on line 30 of her 2021 Form 1040. A 2021 return can be filed to seek a refund until April 15, 2025.
