I just went to the IRS website and the 14039 form states that this cannot be used if the other parent misused the ssn and filed first as this is not classified as identity theft. Need to talk to a tax professional, especially if this number changes every year.

You may be able to opt-in to the IP-pin program without proof of identify theft.

You may need to make an online IRS account for the child, I don't know if this is possible.
It is also true that, once you have an IP pin, it changes every year and you need it for life (at least, under current regulations). So getting an IP pin for a minor child may burden them in the future. So this should be factored in to the decision.
You might ask a local attorney to write a "Cease and Desist" letter to your ex.

@Teshia85 - when you file your tax return, the IRS will see that two people have claimed the same child and they will figure it all out. Be prepared to prove that your son lived with you at least 183 days of the tax year. if you have not filed yet, you must paper file

If someone else claimed your dependent already, then your e-filed return will be rejected. Print, sign and mail your own return which claims your dependent. Mailed returns are processed differently by the IRS. It will take some time (maybe even up to a year) but eventually the IRS will contact both parties and sort out who could rightfully claim the dependent. The person who wrongfully claimed the dependent will face repayment of refund $, plus penalties.
When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.
@michelle-31 you can establish a PIN number to prevent this from occuring next year. With the PIN only the person who knows the PIN (presumably only you) can electonically file a tax return with a specific social security number listed.

Since that person apparently has your son's SSN, watch out for Identity Theft. But be aware that, if that person has the right under tax law to claim him, they do not need your permission to do. Conversely, you cannot grant permission to someone unless the tax law allows it.
