Where to File for Unemployment

Hello,

 

I have a situation that I'd like advise on, if possible:

- I've been working at a job that is supposed to be NY based, but only spent 55 days in NYC in 2022

- Late 2021, I bought my primary residence in Miami, FL and I've spent most of my time there in 2022

- I officially transferred to a new role within the same organization in Oct 2022. This job was full time remote but based in Miami

- In November 2022, I was laid off but continued to be paid biweekly (notice pay, because of the WARN period)

 

I'm working on my tax returns and trying to claim as much NY state and city tax as possible. I'm about to apply for unemployment benefits and I don't know where to apply:
- Florida: $275 per week with a maximum of $3,300 (12 weeks). I have to have worked there "in the past 12 months"

- NY: $830 per week with a maximum of $21,580 (26 weeks). I have to have worked there "in the past 18 months"

 

My questions are the following (as I don't see to be eligible to apply in Florida):
- Am I allowed to claim unemployment in NY, even if I claim NY taxes back?
- If I claim it and it's approved, how will this benefit be taxed next year? Will I be NY taxed only on the unemployment income I receive, or on all my income?
Please note that I do not intend to come back to NY and plan to stay in Florida.
