Excluding payments for non qualified plans from NYS taxes

I live in NJ and work in NY.  I recently switched jobs in NY and I receive a pension from the Firm in NY that I left. For monthly payments from my qualified plan I receive a 1099R and am able to report the pension income for Federal and NJ and exclude from NY.   I also receive monthly payments from the non-qualified plan which is reported on a W-2 in box 1 as wages but not in box 11 (non qualified plans).  The total of the non qualified payments also appears in 14 as 'other SUPP PEN'.   I've read articles that payments from a non qualified plans that last for life should be excluded from NYS taxes but I don't know how to get that reflected in Turbo Tax.  Am I right that these payments should be excluded from NYS and, if yes, how do I do that in Turbo Tax.

If you have no New York income, you don't need to file a New York return.

 

Your pension payments (of any kind) get reported in your Resident State only, since you did not live in New York at all (unless NY tax was withheld).

Thanks so much for responding.  The non-qualified payments are reported as wages in box 1 of my NYS W-2 (from the Firm I left) and also reported in box 14 listed as 'Other - SUPP PEN'.   Right now turbo tax is including in my NY tax return as taxable wages.  I have to file a NYS tax return as I'm working for another Firm in NY where I do have taxable wages.  How do I get turbo tax to exclude these supplemental pension payments from this non qualified plan that are included in box 1 from my former Firm?  Thanks again!

Box 14 on your W-2 does not affect your tax return; it is informational.  Is the Box 1 amount also showing in Box 11?

 

If so, you can make the exclusion entry directly on the New York forms (Line 29, IT-201).

Thanks again for responding.  These payments are just in box 1, not in box 11.  The box 14 description is SUPP PEN.

It depends. According to the following NYS link, "The IRS determined that payments received from the nonqualified plan were wages for federal income tax purposes and were reported on a Form W-2 (only the amount in Box 11 – Nonqualified plans – is eligible for the exclusion). If there isn't an amount listed in Box 11, then this non-qualified pension payment is not eligible for the exclusion.

 

If you feel this is in error, you may wish to contact the HR Dept to issue a corrected W2 reflecting the amount in Box 11.  It may be an error on their part for reporting in this Box 14 rather than Box 11. As MarilynJoy mentioned above, Box 14 is informational only thus anything recorded in this box has no impact on your tax return because it is strictly informational.

I am a NYS resident.  I know pensions are taxable in NYS, but my question was whether the NQ pension reported on a W-2 are eligible for the exclusion up to 20k (given that I’m older than 59 1/2).  Thank you
