The instructions at the top of Schedule W (Delaware) state:
"If income of non-resident taxpayers derived from Delaware sourced employment includes income earned while working outside of the State of Delaware, an allowance will be permitted for those days worked outside of the State. The allowance will be equivalent to the ratio of days worked outside of the State versus the total number of Delaware sourced employment working days. Any allowance claimed must be based on necessity of work outside the State of Delaware in performance of duties for the employer, as opposed to solely for the convenience of the employee. Working from an office out of your home does not satisfy the requirements of “necessity” of duties for your employer and is considered for the convenience of the employee unless working from home is a requirement of employment with your employer."
So, are you filing a nonresident return for Delaware? Were you working for a Delaware company while the company wanted you to live out-of-state?
Hello,
That's correct, I'm filing a nonresident return for Delaware. I'm a PA resident, and my employer is a company in DE. Since the office was closed part of the year (due to Covid), I will split my income between DE and PA.
Schedule W should be used for that, but I don't know how to add it to my state return.
Any suggestions?
BillM223,
I found your response here:
Where is Delaware Schedule W? I did not work in th... (intuit.com)
Thank you!
I hate to whiplash you, but it appears that TurboTax just added form 502LU to the CD/desktop software (and likely the Online software as well).
When you enter the Maryland interview, you will see a screen titled "Maryland Benefits from Unemployment Compensation" where you can override the calculation for the taxable amount of unemployment consumption (this should not be necessary, the $10,200 was automatically subtracted).
This will generate form 502LU and add it to your return.
Sorry for the confusion, but with all the daily changes, it is hard to even us to keep up. For example, they haven't added this form to the state forms availability list, but it is obviously there in the return.
