Hello, At present, I am working in Philadelphia and my husband is a graduate student (earning stipend) in Maryland. Can we file taxes together?

He also has to file additional paperwork for trust fund, would it be better to file separately ?

You and your husband can file taxes together, even though you live in different states.  

 

Since you live and work in different states, you may need to file as a part-year resident or nonresident in each state, depending on your specific circumstances. This means reporting the income earned in each state separately.

 

If your husband has to file additional paperwork for a trust fund (such as Form 1041), it might be simpler to file separately to keep the trust income separate from your joint income

 

Start with MFJ, as it usually offers the most tax benefits, but compare both scenarios.
