System did NOT allow me to e-file since I had excess deferral in my 401k , even after I followed instructions. Will I be penalized by NY state for not e-filing my return?

No. In April 2012, the New York Department of Taxation removed the formerly-imposed $25 penalty.
However, if you use tax software that supports e-filing and you have a broadband connection, the New York Department of Taxation requires that you e-file. But you are not penalized if you don't.
