I just want the penalty to be excluded on my return and ask IRS for waiver.

I believe you are referring to the late payment of tax penalty. If so, you can go to the Other Tax Situations menu and choose Additional tax payments and then Underpayment penalties. Work through that section and you will see a screen that says Let the IRS Bill Me later. Choose that option and you can request an abatement of the late payment of tax penalty when the IRS bills you for it:
