Yes, your child can be your dependent regardless of whether you file as married filing jointly or married filing separately.  You don't need to include your spouse in order to claim your child.

I responded to the other thread you started prior to reading your post in this thread.   Given the fact that the initial transfer was motivated by his illness (that presumably could result in death), it could be argued that a gift was not the intent unless he passed during the time you were the remainderman. In other words, that the "gift" of the remainder was contingent upon his passing but not effective if he did not pass. A gift contingent upon an event occurring is NOT a completed gift and is not treated as such legally unless and until that event actually does occur.   Regardless of how this matter is treated, the only thing you need to be concerned with in the transfer is filing a 709 for the gift of the remainder back to the grantor (the son). If you haven't exceeded your lifetime exemption, you will owe no tax.

And how much is the loss?   Did you have any sales with gains?   If you have investment sale losses, after you subtract the losses from your gains then if you have a net loss, you can only deduct up to 3,000 per year.  The rest you have to carryover over to the next year.   So you might want to amend 2024 also.      You have to report the carryover every year until it's used up.  You can't skip a year.  Even if you don't report it on your return you have to reduce it by the 3,000 (1,500 MFS) when you carry it over to next year.  You can't choose when to use it.

I would love to get a answer ASAP on a life estate deed my name is on..I am named remainderman on my sons dads life estate deed…I want to remove my name but don’t know if taxes will be involved? The house was quit claimed to me! Will my son’s dad or myself have to pay taxes if I quit claiming it back to him? We both agree on this but don’t know if  there’s any taxes involved?  I’m getting mixed answered, one said not sure, one said no because of a life-time excursions??  Can you help explain this Please?  We live in RI

My sons dad ( we were never married) gave himself a life estate and named me as remainderman on the house/deed….It’s been 15 months since doing this. He was very sick at the time and wanted to make sure his son and I have a place to live so he did the quit claim deed…He named me as remainderman because our 45 year old son doesn’t know anything about paying bills, taxes, etc. So that’s why he named me to take care of things…My question is, if I have my name removed from the deed and he has it put back in his name without a life estate, will he have to pay a gift tax or will I because I’m quit claiming it back to him?? He quit claimed it to me for $1.00 and I will be doing the same back to him…. We live in RI .  Thank You

If that answers your question. So even when I go through turbo tax now to try to amend the taxes, I had do download the software from 2022 and even after reentering my 1099r’s, it continues to to put the direct rollover amounts into the 1040 in line 5b. I just don’t get it. Short of filing on paper which I don’t want to do because i feel like it’s not as streamlined,  I’m not sure what other options I have. The way I ended it with the tax expert from Turbo tax yesterday was she was going to continue working on figuring out why this keeps happening and call me today, my only concern with that is right after we hung up I received an email from turbo tax saying my case number for my issue was closed. So I’m not sure why it was closed before a resolution and before I got the callback I was promised

The forms would be included in the PDF of the tax return in the tax year the return was completed. Copies of a Form 1099 would have to obtained from the issuer of the form.   To access your current or prior year online tax returns sign onto the TurboTax website with the User ID you used to create the account - https://myturbotax.intuit.com/ Scroll down to the section Your tax returns & documents.
