Did anyone ever figure this out? I have similar questions about tracking passive losses for states.

When filling out the NJ State Return form with Turbotax, it's counting my capital gains from stocks as sales of property. Is this defect in the software/website? It gives me the option to omit those out in the next page, but I just want to double check before omitting them just in case there's some weird law where NJ counts capital gains from stocks as sales from property.

Hi @Opus 17 , revisiting your answer while finalizing NY state tax return for 2024. The most confusing part to me is that, on IT-196 instruction for 2024: Lines 5 through 7 If, on your federal income tax return, you claimed an itemized deduction for state and local taxes you paid, enter the applicable amounts from federal Schedule A, lines 5a, 5b, and 5c. -> But this should NOT include NY state and local taxes included in 5a, 5b or 5c, is this correct? I'd appreciate it if you could answer this question.

It sounds like you sold stock you received from a Restricted Stock Unit (RSU) award. If that is the case, then you have to adjust your cost basis to account for the fact that the value of your RSUs was included in your taxable income. You also could have acquired the stock from Non-Qualified Stock Options (NQSO). You need to determine exactly what kind of company stock award you got the stock from to determine how to report the 1099-B.
See the following TurboTax article: What are restricted stock units (RSUs) and how do I report them?

I'm not clear from your response if we need to file form 593 or not? I am exempt from withholding due to marking #1 in part III. At the beginning you stated "You don't need to enter Form 593 in your tax return at this point...". Then later in bold wrote "A seller/transferor that qualifies for a full, partial, or no withholding exemption must file Form 593". Am I correct that if I have already signed Form 593 and given it to escrow they will take care of filing it and I do NOT need to include it in the tax return?

I am in the same boat with ET ownership and pretty disappointed TTax does not handle the 8990 in simple situations. I have a minuscule amount of line 13 code K being reported (Excess Business Interest Expense) and I have no intention of using it as a deduction. This is my first year of TTax after getting tired of paying to have the return done. I looked back at what the tax accountant did and found they filled out the schedule A of the 8990 to record the values but ultimately put zero's in the 8990 Section one and the rest of the form where totals are recorded. So I guess I could send this 8990 separately by mail to the IRS but how would they know to marry it to my e-filed return? I saw on an older post that maybe don't bother filing it at all given it's not going to be used in the end to reduce any taxes. I think I'll just hold it until the IRS requests it for now unless anyone else has an alternative solution.

It is good that you want to get caught up You need help from a tax pro. First....the software only goes back to 2021---TurboTax software is not available for earlier years. And your refunds for the years prior to 2021 have been forfeited, but if you owe tax due, it is owed with late filing penalties and interest. A tax pro may be able to help you negotiate the amount you have to pay. If 2021 is not mailed by midnight on April 15, 2025 that refund is also forfeited.
Only a 2024 return can be prepared online and only 2024 can be e-filed. Earlier years must be filed by mail. They cannot be combined in any way. Each tax year is a separate return and must be prepared on the forms for the specific year in which the income was received.
Do you have all of the W-2's, 1099's and other tax documents going back seven years?
If you want to tackle some of this :
You cannot change the tax year. The current online program is for 2024 only. Only a 2024 return can be prepared online and only a 2024 return can be e-filed.
Online preparation and e-filing for 2021, 2022, and 2023 is permanently closed.
Note: The desktop software you need to prepare the prior year return must be installed/downloaded to a full PC or Mac. It cannot be used on a mobile device.
To file a return for a prior tax year
If you need to prepare a return for 2021, 2022, or 2023 you can purchase and download desktop software to do it, then print, sign, and mail the return(s)
https://turbotax.intuit.com/personal-taxes/past-years-products/
You may also want to explore purchasing the software from various retailers such as Amazon, Costco, Best Buy, Walmart, Sam’s, etc.
Remember to prepare your state return as well—if you live in a state that has a state income tax.

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. Use a mailing service that will track it, such as certified mail so you will know the IRS/state received the return.
Federal and state returns must be in separate envelopes and they are mailed to different addresses. Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.
I suggest preparing 2021 ASAP to seek the recovery rebate credit for the 3rd stimulus payment of $1400. Tomorrow is the deadline to get that. If no one else could claim you as a dependent for 2021, you could still get the $1400.
If you could be claimed as someone else's dependent in 2021, you are not eligible for the payment.
If you were eligible and do not receive a payment soon from the IRS, the other way to get the payment is to amend your 2021 return to use the recovery rebate credit before April 15, 2025. If you did not file a 2021 return at all, then prepare one and mail it in.
