Yes, you should amend your West Virginia (WV) return to remove the tax on your income because you were not a resident at all during the tax year. You will use Schedule A to determine the amount of WV nonresident income and the tax will be calculated based on the WV income vs the total federal income. You will both still be on the same return, however the tax will be applied based on her income and not yours. You will use the married filing separately status.   WV generally requires married couples with different residency statuses (e.g., one resident, one non-resident) to file separate state income tax returns. If one spouse is a full-year resident and the other is a non-resident, they must file separate returns, even if they filed a joint federal return. WV Forms and Instructions (see page 19 and see Schedule A page 7) Note: Since WV and Pennsylvania (PA) are reciprocal states, if there was any PA state withholding on your spouses' income a full refund would be allowed on the PA nonresident return for the WV income.  If there was no PA tax withheld, no PA state return is required for your spouse.

@hccheung  I saw and therefore recreated a similar situation for another user  using  Multiple RIC and two separate country.  I did almost all the entries in the step-by-step mode  and then finally went to  the form 1116 Comp wks. and saw a few issue . This is when I saw that the actual worksheets for the  1099-DIV had  no / incomplete entries for  total asset , adjustment and then adjusted basis.  Corrected these and then everything worked fine.  The part that I did not do and will do now, is whether Turbo had any screens asking for  those details -- because absent that  how does the user  know when and what to enter for these entries.   It seems  that Turbo expects the  users of form 1116 to have quite a bit of knowledge about the form 1116  ( generally would be a stretch ).  So let me create the scenario and I will come back in a few.   pk

Take standard deduction.   The added $10,000 interest was just testing a what if scenario. My expectation was a straight 24% tax.   D'OH!  A Homer Simpson moment.   Typing this out it dawned on me that I lose part of the Additional Senior Deduction.   That explains change in the marginal rate.   Thanks for the memory jogger.   SOLVED.

This still does not work.  My Wisconsin Tax e-file was rejected so I updated my TurboTax on 18FEB2025 and resubmitted that day. It was rejected again on 20FEB2025 and I received a message that there will be a new update on 26FEB2025 and to log after that to resubmit.  This appears to be a major failure from Intuit TurboTax with a bunch of untruths to buy them time.  I have been a TurboTax customer for decades but unless I get some honest information on what is going on with TurboTax, I will be looking at other products next year.

 It depends.  If you established domicile in Maryland, you would be required to file a part year return.  See Domicile and Residency and How do I file a part-year state return? - TurboTax Support - Intuit.   In addition, because Pennsylvania and Maryland are reciprocal states, you must review your income entries.  See What's a state reciprocal agreement? - TurboTax Support - Intuit.

I assure you I have done multiple google searches in hundreds of ways at this point. As previously noted, not only does the situation not fit the definition of a scholarship (was not meant to pay for school) but even with the wording you have there, once a 1099 MISC is issued it negates the next line in my view.  I truly wish I could be comfortable suing it that way.   I have gone so far as to read the legal statues and as much IRS documentation as I can. I give you this as one example of many from Cornell Law:  26 U.S. Code § 117 - Qualified scholarships   (a)General rule Gross income does not include any amount received as a qualified scholarship by an individual who is a candidate for a degree at an educational organization described in section 170(b)(1)(A)(ii). (b)Qualified scholarship For purposes of this section— (1)In general The term “qualified scholarship” means any amount received by an individual as a scholarship or fellowship grant to the extent the individual establishes that, in accordance with the conditions of the grant, such amount was used for qualified tuition and related expenses. (2)Qualified tuition and related expenses For purposes of paragraph (1), the term “qualified tuition and related expenses” means— (A) tuition and fees required for the enrollment or attendance of a student at an educational organization described in section 170(b)(1)(A)(ii), and (B) fees, books, supplies, and equipment required for courses of instruction at such an educational organization. (c)Limitation (1)In general Except as provided in paragraph (2), subsections (a) and (d) shall not apply to that portion of any amount received which represents payment for teaching, research, or other services by the student required as a condition for receiving the qualified scholarship or qualified tuition reduction. It is too soon to amend your return now. ‌Once your return is fully processed, you can amend as soon as the federal amended tax return form 1040-X is available for filing in TurboTax. The IRS might automatically correct for the missing W-2, and then you would not need to amend.   Use this tool to check availability of forms, including 1040X: Tax form availability. The Form 1040-X for amending a 2025 federal tax return is estimated to be available in TurboTax on 02/25/2026   An amended return, Form 1040-X, can only be printed and mailed to the IRS if the original tax return was not e-filed. The IRS will take up to 20 weeks or longer to process an amended tax return. Before starting to amend the tax return, wait for the tax refund to be received or the taxes due to be paid and processed by the IRS.
