Dependent education (pre-school) fringe benefit

My wife is a teacher and receives a fridge benefit of sending our child to that school (pre-school). It is listed as income on the W-2, but can I claim the costs as dependent care? It is listed as "Misc. Pay" as opposed to "Regular" on the pay stub, then deducted on the same pay stub as "Tuition" under voluntary deductions.

Yes, pre-school qualifies as a child care/dependent care expense. If your wife was not able to bring your child to the school where she teaches, you as working parents would have to make alternate arrangements in order to care for your child.
