Perhaps.

 

IRS Forms 3921 are to be mailed to taxpayers by January 31, 2022.  See  IRS document here.

 

Did you sell stock that could have been reported on an IRS form 3921 for 2021 or a previous year?  Please clarify.

 

The purpose of IRS Form 3921 is stated in this IRS publication.

 

Who Must File

 

Every corporation which in any calendar year transfers to any person a share of stock pursuant to that person's exercise of an incentive stock option described in section 422(b) must, for that calendar year, file Form 3921 for each transfer made during that year.

Turbo is telling me I must verify ISO form 3921, but I never received one. I retired last year from a French company and the US office can't tell me anything about this form locally. I searched all my paperwork and could only find a letter from the French Broker dated 2020 telling me of a stock reversal in which I ended up with fractional shares.

Due to the fractional shares, they sold these and the funds were supposably sent to one firm and then another.  I have not received funds for the sale at this time due to losing a lot of paperwork during the Texas freeze last year.  Lost form for transferring funds to my bank account. Neither of these companies claim they sent out 3921. 

I just emailed the french broker who sold the fractional shares to see if they by chance issued the 3921. 

Turbo will not finalize my return until this if verified.

Form 3921 is an informational form only.  The information contained within the form is generally not entered on your tax return unless you then sold the stock, or if you could be subject to alternative minimum tax (AMT).  From you question, it appears the company sold your fractional shares; however, you also mentioned that you have never received the proceeds.  

 

At this point, what are you being asked to verify?  Are you being asked to verify that all of the information on Form 3921 (which you haven't received) is accurate?  It seems you are not in a position to verify anything on Form 3921, because you don't have it.  In other words, you don't know what it contains.  Given that you don't have Form 3921, are you reporting sale proceeds from the sale of the fractional shares?  If so, and you are confident that the entries are correct, can you confirm with your former company that the information you have entered is correct?  If you can, and that information is the same that would appear on Form 3921, then you should be able to verify Form 3921, even though you don't have it, because you were able to verify the Form 3921 information independent of having the form.

Thank you. When turbo is reviewing my return, it keeps telling me to input ISO sale information which I don't have. I am assuming that I was to receive the 3921 when the fractional shares were sold but as of today I have not.  I also am assuming that the broker per IRS code sent the 3921 to the IRS and that is why turbo is requesting it to compare information.  The only information on the reverse stock letter is fractional amount of shares and final selling price per share. I don't have the original offering price and date as it was over many years. 

Correct that I have not received any of the proceeds as I never provided bank transfer information. I know for sure that this is a loss on sale.  Hopefully the French broker will reply to my email in the next few days.

Forgot to mention the letter of reverse stock split and fractional share sale was October 2020, if that may help.

As of right now it sounds as though you don't have enough information to put this on your tax return.

 

I'm not sure how certain you are that this sale actually took place in 2021.

 

You need more information before you can enter this onto your tax return.  Wait til the broker contacts you OR file your taxes without it and amend your return to add it on once you've received the information from your French broker.
