I formed a multi-member LLC 3 years ago and was the responsible party with the IRS on the SS-4 until last year when I sold my share in the business.
The new owner kept the EIN, and supposedly filed a change of address / responsible party form. I have a copy of the form but I don't know if he ever mailed it in, if it was confirmed, etc.
My accountant checked the "final return" box on our short form for 2020, so there is at least some record of that being the final multi-member LLC return.
Anyway, I have been wanting to verify that my name has been removed from the EIN. I don't want to be responsible if the new owner fails to file his taxes, etc. etc. When I called in, the representative asks me for the EIN and my title at the same time. I don't want to lie to her, so I say "former owner". When I say that, they immediately refuse to talk to me, even though all I'm doing is trying to determine if I'm still listed on the EIN.
Is there another way to verify I am no longer the responsible party? Or does the "Final return" checkbox on the 2020 short form return cover me even if he doesn't file things properly moving forward?
I know some of you may say that since it was a partnership, he needed to get a new EIN. I verified dozens of times that he in fact didn't need a new EIN, and could use the existing one moving forward, and the IRS had confirmed that as well. Thanks for any help!

If nothing else you can file form 8822-B
The new owner filed 8822B. I have a copy of it. Like I mentioned, I'm not sure if it was ever sent it.
Are you saying I'm able to file 8822B as well, and sign my name as if I was an authorized representative still?
Yep.....file the form if you're not sure it was ever sent and you could include a short statement describing the circumstances.
OK, thank you! It's just frustrating they won't even look up the account. If she says "I can't talk to you about this account", I would have my answer....
