Stimulus check reimbursement for 2019 and 2020

Should I amend my taxes in order for my 27 year old son who is an adult living with me, but who I provide more than 50% of his support and therefore Turbo Tax suggested I file Head of Household both years. 2019 was the last year I was able to claim my son as a dependent and this year Turbo Tax acknowledged this, but said I would receive a tax "credit". When my son used Turbo tax for his EZ return, it was not accepted and said something to the effect that he wasn't eligible for the 3 stimulus checks because I had claimed him on my taxes. Should I have used a different filing status, Divorced, filing single and not claimed my son as a dependent? Thank you

If your son is a qualifying relative then even it you don't claim him he still cannot claim himself. 

 

WHO CAN I CLAIM AS A DEPENDENT?

 

You can claim a child, relative, friend, fiancé (etc.) as a dependent on your 2019 taxes as long as they meet the following requirements:

Qualifying child

  • They are related to you.
  • They cannot be claimed as a dependent by someone else.
  • They are a U.S. citizen, resident alien, national, or a Canadian or   Mexican resident.
  • They are not filing a joint return with their spouse.
  • They are under the age of 19 (or 24 for full-time students).
    • No age limit for permanently and totally disabled children
  •       They live with you for more than half the year (exceptions apply).

Qualifying relative

  • They don't have to be related to you (despite the name).
  • They cannot be claimed as a dependent by someone else.
  • They are a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
  • They are not filing a joint return with their spouse.

 They lived with you the entire year.

  • They made less than $4300  (not counting Social Security)
  • You provided more than half of their financial support. More info

The issue is whether you can claim him, not if you claim him. If you provided more than 50% of his support and his income was less than $4,300 you are eligible to claim him. In that case he can’t receive any stimulus even if you choose not to claim him.  If his income was more than $4,300 you cannot claim him in which case he would receive the stimulus.
