Form 8615 and parents refusing to give information

I was filing my tax return on turbotax for 2023 and the form 8615 popped up needing my step-dad's SSN (because he is listed as 1st on my mom's joint filing of taxes). My mom refuses to give me any information about either of them for my taxes, FAFSA, and everything else. However, I cant file my taxes without this information. What can I do?

Form 8615 and parents refusing to give information

Form 8615 is used when a child (under 18, or under 24 while a full time student) has investment income or other unearned income in their own name.  In some cases, their tax rate is based on their parent's income (to prevent parents from getting a tax break by putting investments in a child's name when the child has a lower tax rate).

 

The instructions say that if the parents won't provide the information, you can request it from the IRS by mailing them a letter and copies of certain documents.  If you don't get the information by the April 15, 2024 filing deadline, request an extension and wait to file until you get the information.

 

You may want to point out to your parents that this information (as well as information about their income, which will come later) is required by the IRS for you to file, and the IRS will give it to you if they don't.  They may be more cooperative.

Alternatively, if they are trying to treat you as completely financially independent, you should review the filing requirements in the instructions to see if you might meet one of the tests to not have to file the form, then change your answers in turbotax to reflect that. 

 

Parent's return information unavailable.

If a child can’t get the required information about his or her parent's tax return, the child (or the child's legal representative) can request the necessary information from the IRS.

How to request.

After the end of the tax year, send a signed, written request for the information to the Internal Revenue Service Center where the parent's return will be filed. (The IRS can’t process a request received before the end of the tax year.)

The request must contain all of the following.

  • A statement that you are making the request to comply with section 1(g) of the Internal Revenue Code and that you have tried to get the information from the parent.

  • Proof of the child's age (for example, a copy of the child's birth certificate).

  • Evidence the child has more than $2,300 of unearned income (for example, a copy of the child's prior year tax return or copies of Forms 1099 for the current year).

  • The name, address, SSN (if known), and filing status (if known) of the parent whose information is to be shown on Form 8615.
