My father passed away in April.  He had a revocable trust.  I am successor trustee.  I was wrongly told by his bank that I needed an estate EIN.  What I needed was a trust EIN.  Do I have to file from 1041 for the estate when the estate has no income?  I know normally it would not but since I have the EIN I am not sure.  I know I will have to file for the trust.

Get an EIN for the trust and don't file a 1041 for the estate. If the IRS asks, tell them the estate had no income or expenses.
