2019 Tax

I filed a 2019 paper return with my tax payment early Feb 2020.  The IRS cashed my check on 02/12/2020 but did not process my return.  In July I was advised by the IRS to submit a second return.  In November I get a letter from the IRS saying they got my payment but no tax return.  I wrote a letter explaining to the IRS what was going on and asked them to investigate.  I know they received the letter because I had a tracking number.  I have called the IRS about every month for almost 9 months and no resolution.  In the mean time no stimulus check because they are basing off of 2018 tax return.  How long to I wait before I as for an advocate

I sent the second one in on the advise of the IRS when I called. I was reluctant on sending it so I wrote duplicate across the top of it.

If you wrote 'duplicate' on it, hopefully it won't cause an issue.  But I really would not be surprised at anything that happens this year.  They have your money and you can verify that so at least they won't penalize you for their internal issues.   I wouldn't worry about the 2019 return right now since it won't have any real effect on your 2020 filing.  When filing season opens later this month, go ahead and get your 2020 filed so you get your refund and stimulus and maybe by then, they will have your 2019 return straightened out.  Good luck!

It depends.  However, if your 2020 return qualifies you for the stimulus payment, then you will get the refund included with your 2020 tax return.  (Based on your incme, filing status, number of dependents, etc.

I know I will qualify for stimulus checks based off of my 2020 tax return. But the IRS is trying to treat my 2019 tax payment as a credit on my account since they don't know where my 2019 tax return is.  I just don't know how they can send out letter stating that I have a missing tax return when they still have a million plus 2019 tax returns that have not been processed.

The payment you sent in for your 2019 tax return will have no effect on your 2020 tax refund which will include all of the stimulus funds you are eligible for.  Your eligibility is dependent upon your 2020 income, which you know you qualify for.  You may have to send in a copy of your 2019 tax return for them to get that year settled, but the payment you made for 2019 will have no impact on receiving your 2020 refund (and stimulus payments).   When you file 2020, you will claim the credits for all the payments you missed on that return.
