I am a US Citizen living in Canada on my husband's work visa (he is working for a Canadian company) and I'm continuing to work for the same US company I was working for before I moved. I was receiving a 1099 before, but now the company is switching to have employees and want me to fill out a W-4. Since I'm in Canada, should I keep the independent contractor status and continue to get a 1099? Can I be considered an employee of the company if they don't have a presence in Canada? Any help would be greatly appreciated!

As a U.S. citizen living in Canada, there is nothing prohibiting you from being an employee of a U.S. company with no presence in Canada.
